Terms and Conditions of Purchase

These Terms and Conditions govern purchases made through the Forja3D online store.

The identification and contact details of the owner of the store can be found in the Legal Notice available at www.forja3d.es.

By placing an order, the customer acknowledges that they have had the opportunity to review these Terms and Conditions and agrees to be bound by them, without prejudice to any rights granted to consumers and users under applicable law.

1. Orders and Purchasing Process

1.1. Placing an Order

The customer must select the products they wish to purchase, provide the information required to process the order, and choose from the available payment and shipping methods.

Before completing the purchase, the customer must check that the products, quantities, delivery address and all other information provided are correct.

The customer must also review the product description, short description, specifications, scale, quantity and any other information available on the product page before completing the purchase.

1.2. Receipt and Validation of Orders

Once the purchasing process has been completed, Forja3D will send the customer an electronic communication confirming that the order has been successfully received.

Communications generated automatically by the store are intended to confirm that the order has been correctly registered in our systems and to provide the customer with a summary of the transaction.

Forja3D may subsequently carry out any necessary checks relating to, among other matters:

Successful receipt of payment.
Product availability.
The price and taxes applied.
Discounts and promotions used.
Shipping costs and conditions.
Information provided by the customer.
The existence of technical or material errors.
Possible fraud or misuse of the store.

The automatic receipt of an order shall not prevent its subsequent correction or cancellation where any of the objective grounds set out in these Terms and Conditions or provided for by law apply.

2. Prices, Errors and Order Cancellation

2.1. Prices

As a general rule, the applicable prices will be those displayed in the store at the time the order is placed, including any taxes applicable under current legislation.

Forja3D makes every reasonable effort to ensure that prices, discounts, promotions and other financial information displayed in the store are correct and up to date.

However, due to the large number of products and the automated processes used to update, import and synchronise the catalogue, material, typographical, technical or computer errors may occasionally occur.

2.2. Obvious Pricing Errors

Where a product, discount, promotion, shipping charge or total amount is displayed at a price that is manifestly and objectively incorrect as a result of a material, typographical, technical, computer, configuration, import, synchronisation or calculation error, Forja3D may cancel the order or the part of the order affected by such error.

The following circumstances, among others, may be considered particularly indicative of an obvious error:

Products accidentally displayed at a zero or near-zero price.
Prices clearly disproportionate to the product's usual price.
Decimal-point placement errors.
Discounts greater than those actually advertised.
The stacking of promotions that should not be compatible.
Multiple or repeated application of the same discount.
Errors in tax calculations.
Currency conversion errors.
Errors occurring during the import or updating of prices.
Errors in shipping rates or shipping charges.
Technical failures resulting in an amount clearly different from what could reasonably be expected.
Any other circumstance objectively demonstrating that the displayed price is the result of an error and not an offer or promotion deliberately made by Forja3D.

The fact that a price is lower than usual shall not, in itself, constitute sufficient grounds for cancelling an order where it could reasonably be interpreted as a valid offer, promotion or discount.

This clause shall apply only where there is a genuine and objectively identifiable error.

2.3. Procedure in the Event of a Pricing Error

Where Forja3D identifies an obvious pricing error before the order has been finally processed, it may inform the customer of the correct price and offer the customer the option of proceeding with the purchase under the correct conditions.

Forja3D will not unilaterally increase an amount already paid by the customer.

The customer may:

Expressly accept the correct price and, where applicable, pay the difference.
Reject the correct price and cancel the affected product or order at no cost.

If the order is cancelled and any payment has already been made, Forja3D will refund in full the amounts charged in respect of the cancelled products or services.

2.4. Other Objective Grounds for Cancellation

Forja3D may cancel an order, either in full or in part, where an objective circumstance arises that reasonably prevents its fulfilment, including but not limited to:

Subsequent inability to manufacture or obtain the product.
A product being withdrawn, discontinued, or its production being cancelled by the manufacturer, designer or supplier.
Inability to supply the product as communicated by a supplier.
Inability to ship the order to the destination provided.
Incorrect or insufficient delivery information that prevents the order from being processed and cannot be corrected.
Inability to successfully receive or verify payment.
Reasonable indications of fraudulent use of a payment method.
Reasonable indications of identity theft or impersonation.
Fraudulent or abusive use of vouchers, promotions, points or loyalty programmes.
Creation or use of multiple accounts for the purpose of circumventing the restrictions of a promotion.
Deliberate manipulation or exploitation of a technical error in the store.
Orders generated through automation, computer errors or procedures intended to obtain conditions that were not genuinely offered.
Any legal, administrative or other obligation preventing the transaction from being completed.

Forja3D will not exercise this right merely because, after the order has been placed, it considers a correctly completed sale to be unprofitable or commercially inconvenient.

Where an order is cancelled and the customer has already made payment, the amounts corresponding to the cancelled products or services will be refunded.

3. Shipping

3.1. Preparation Times

Due to the nature of our products and their manufacturing and preparation processes, the usual estimated dispatch time is 3 to 10 business days from the date the order is placed, unless a different period is expressly stated on the relevant product page.

Certain products may be subject to specific manufacturing, preparation, pre-order, restocking or supply times.

Where a different period is expressly stated on a product page, that specific period shall take precedence over the general timeframe indicated above.

For orders containing products with different preparation times, the order may be subject to the timeframe applicable to the product requiring the longest preparation period, unless Forja3D expressly states otherwise.

The stated timeframes are estimates where they depend on manufacturing, supply or transportation circumstances beyond Forja3D's direct control.

If an incident occurs that may cause a significant delay, Forja3D will endeavour to inform the customer as soon as reasonably possible.

3.2. Shipping Carrier

During checkout, different shipping carriers or delivery methods may be displayed depending on the delivery address provided by the customer.

The shipping carrier selected during checkout shall be considered the preferred carrier, but shall not necessarily be exclusive or guaranteed unless expressly stated otherwise.

Forja3D may use a different shipping carrier from the one initially selected where logistical, operational or economic circumstances make such a change reasonable.

Such a change may be made, among other circumstances, where there is:

Unavailability of the selected carrier.
Lack of coverage or service limitations in the destination area.
Known incidents affecting the carrier's network.
Exceptional delays.
Restrictions arising from the weight, dimensions or characteristics of the parcel.
Exceptional or unforeseen surcharges.
A disproportionate difference between the shipping cost initially calculated and the actual cost required for that shipment.
Technical problems when booking the shipping service.
Any other logistical circumstance that reasonably makes it difficult to use the carrier initially selected.

In such cases, Forja3D may assign a different shipping carrier at no additional cost to the customer, while endeavouring to use a service with reasonably equivalent characteristics and delivery times.

The amount paid for shipping relates to the preparation and delivery service purchased for the order and does not necessarily correspond to the exact amount subsequently invoiced to Forja3D by a particular shipping carrier.

Unless expressly stated otherwise, selecting a carrier during checkout shall not be interpreted as the exclusive and irrevocable engagement of that specific carrier.

3.3. Special or Express Services

Where the customer has expressly purchased and paid for an express service or a shipping method with specific characteristics, and Forja3D is unable to maintain reasonably equivalent conditions through another carrier, the customer will be informed where necessary.

The customer may accept the proposed alternative or, where applicable, receive a refund of the difference paid for the special service that will not ultimately be provided.

3.4. Packaging

All miniatures are shipped using packaging intended to provide adequate protection during transit.

Whenever possible, Forja3D may reuse packaging or use recycled materials.

Shipping charges include costs associated with packaging, logistical preparation and transportation of the order.

3.5. Shipping Costs

Shipping costs will depend on the destination, delivery method and other circumstances applicable to the order.

The applicable terms and rates will be those displayed to the customer during checkout before the order is confirmed and paid for.

The shipping amount displayed during checkout includes the costs associated with preparing, packaging and shipping the order.

Shipping rates, geographical zones, available carriers and free-shipping thresholds may be modified for future orders due to changes in carrier rates, logistical costs, market conditions, service availability or other circumstances.

Any subsequent modification of these rates will not affect the shipping amount already accepted and paid by the customer for a confirmed order, unless there is an obvious calculation or pricing error under the terms set out in the section concerning pricing errors.

Where shipping to a particular country, territory or area is temporarily restricted, this may be indicated on the shipping information page or during checkout.

4. Product Images and Contents

4.1. Illustrative Nature of Images

Photographs, renders and images used on product pages are primarily illustrative and indicative.

Their purpose is to provide the customer with a general representation of the product.

The final appearance of the product may differ from the images as a result of factors including:

The manufacturing process.
The selected scale.
Configuration or assembly.
Updates made by the designer.
Distribution of components.
Material used.
Minor differences inherent to 3D printing.
Modifications or updates to the original files provided by the designer.

Photographs may also show miniatures that are painted, assembled, displayed in scenic settings or accompanied by bases, scenery elements, terrain or other accessories used solely for presentation purposes.

Such elements are not considered included unless expressly stated in the product description.

The product description shall determine its quantity, scale, essential characteristics and any contents expressly stated as included.

4.2. Modular Miniatures

Some products sold by Forja3D are modular miniatures, meaning models designed to allow different configurations by combining bodies, heads, arms, weapons, shields, accessories, poses or other components.

For these products, photographs and renders show examples of assembly and possible configurations and their contents must therefore be regarded as indicative.

Unless expressly stated otherwise in the product description, photographs do not constitute an exact inventory of the parts supplied and do not guarantee the inclusion of each and every variant, weapon, head, arm, shield, accessory or other alternative component visible in the images.

Accordingly:

The combinations supplied may differ from those shown in the photographs.
Poses may vary.
The distribution of alternative parts may vary.
The selection of heads, arms, weapons, shields and accessories may vary.
The simultaneous inclusion of all options visible in the images is not guaranteed.
A specific part visible in a photograph may represent an alternative assembly option.
Different units of the same product may feature different combinations.
Not all variants created or shown by the designer will necessarily be included simultaneously in every set supplied.

Where a product consists of a modular set intended to assemble a specified number of miniatures, the presence of a particular part, weapon, arm, head or accessory in a photograph does not necessarily mean that that specific variant must be included, provided that the contents supplied allow the number and type of miniatures stated in the product description to be assembled correctly.

The product description shall take precedence over photographs for the purpose of determining:

The number of miniatures.
The scale.
The type of unit or product.
Any items expressly stated as included.

4.3. Required Parts and Lack of Conformity

The indicative nature of images of modular products does not mean that components required to correctly assemble the purchased product may be missing.

If a part required to assemble the advertised number of miniatures is missing, an item expressly stated as included is absent, or a defect prevents the product from being used correctly, the customer should contact Forja3D so that the issue can be reviewed.

These conditions relating to modular miniatures do not limit any statutory consumer rights in the event of a lack of conformity.

4.4. Questions About Product Contents

The customer should review the product description before making a purchase.

If there is any doubt regarding the number of miniatures, contents, included parts, scale, modular nature or any other characteristic, the customer may contact Forja3D before placing the order.

5. Bases and Accessories

5.1. Bases

Due to the large number of gaming systems, formats and sizes available, miniatures sold by Forja3D do not include bases unless expressly stated otherwise on the product page.

Bases can be purchased separately at:

Bases, scenery elements and other accessories that may appear in photographs for illustrative purposes shall likewise not be considered included unless expressly stated on the product page.

6. Products Manufactured Using 3D Printing

Products manufactured using 3D printing may have minor characteristics inherent to the manufacturing process.

These may include slight support marks, minor surface variations or other characteristics resulting from the process that do not materially affect the normal assembly or use of the miniature.

Such minor characteristics should not be confused with breakages, missing parts, significant manufacturing defects or defects that prevent normal use of the product.

7. Right of Withdrawal and Returns

7.1. Right of Withdrawal

Where the purchaser legally qualifies as a consumer and the right of withdrawal applies, they shall generally have 14 calendar days from receipt of the order in which to notify Forja3D of their decision to withdraw from the purchase without having to provide a reason.

We recommend including the order number to facilitate processing.

Exercising the right of withdrawal shall not be subject to any penalty.

7.2. Returning Products

Once the withdrawal has been notified, the customer must return the products within the applicable statutory period.

Products must be adequately protected to prevent damage during transit.

The customer shall only be liable for any diminished value of the products resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

7.3. Return Shipping Costs

Where a return is made solely as a result of exercising the right of withdrawal and there is no defect, error or lack of conformity attributable to Forja3D, the customer shall bear the direct cost of returning the goods where permitted by law and provided that the customer has been informed of this in advance.

The customer may use the shipping carrier of their choice, provided that the products are correctly returned to the return address supplied by Forja3D.

Where available, Forja3D may optionally offer to arrange a return label or collection service at a cost of €7.00.

If the customer agrees to use this service, this amount may be deducted from the amount to be refunded.

7.4. Refunds

Forja3D will issue any applicable refunds within the periods established by law.

As a general rule, refunds will be made using the same payment method used for the original transaction, unless another method is expressly agreed.

Where legally permitted, Forja3D may withhold the refund until the products have been received or until the customer provides sufficient evidence that they have returned them.

7.5. Personalised Products

The right of withdrawal shall not apply in circumstances excluded by law.

Such circumstances may include goods made to the customer's particular specifications or clearly personalised, where the requirements established by applicable legislation are met.

Where a product is subject to such an exception, the customer will be informed where appropriate.

8. Defective, Damaged, Incomplete or Incorrect Products

The right of withdrawal is separate from the customer's rights where they receive a defective, damaged or incorrect product, or a product that otherwise lacks conformity.

To help us process the issue more efficiently, we recommend providing:

Order number.
Reference number of the affected product.
Description of the issue.
Photographs of the affected parts where possible.

Forja3D will review the issue and provide the appropriate solution according to the nature of the problem and applicable legislation.

Where there is a lack of conformity attributable to the product or to Forja3D, the measures required to bring the product into conformity shall be provided free of charge to the consumer in accordance with applicable law.

9. Points Programme

The Forja3D Points Programme is intended to reward the loyalty and participation of our customers.

9.1. Earning Points

Orders

Each completed order awards 200 points, unless different conditions are stated as part of a specific promotion.

Product Reviews

Reviews without images: 35 points.
Reviews with images: 45 points.
Maximum of 15 rewarded reviews per customer per month.

Forja3D may review submitted reviews before awarding points.

Duplicate or fraudulent reviews, reviews that do not correspond to a genuine experience with the product, or reviews submitted primarily for the purpose of improperly obtaining points may be excluded.

Store Reviews

A review of the store awards 10 points, with a maximum of one reward per user.

9.2. Using Points

Accumulated points may be redeemed for discount codes or vouchers applicable to the catalogue under the conditions displayed by the store.

The minimum order value required to redeem points is €50 before applying the relevant discount.

Points or discounts generated:

May not be used to purchase gift cards.
May not be exchanged directly for cash.
Do not create a cash or account balance in favour of the customer.
Are subject to the specific conditions displayed at the time of redemption.

Discounts generated through points may be combined with other offers or promotions where permitted by the system and by the conditions of the relevant promotion.

9.3. Expiry

Points are valid for 60 calendar days from the date on which they are credited.

Points not used within this period will expire automatically and may not be reactivated or transferred unless Forja3D expressly decides otherwise.

Discount vouchers obtained by redeeming points are valid for 10 calendar days, unless expressly stated otherwise.

9.4. General Conditions

Points are personal and non-transferable.

The programme is available only to registered customers.

Forja3D may invalidate points obtained through:

Fraud.
Manipulation.
Obvious technical errors.
Fake reviews.
Abusive creation of accounts.
Any action intended to obtain points in breach of these Terms and Conditions.

If an order is cancelled or returned, the points awarded for that order may be withdrawn.

Forja3D may modify, suspend or terminate the Points Programme for technical, commercial, legal or operational reasons.

9.5. User-Generated Content

By voluntarily publishing photographs or comments as part of a review, the user declares that they hold the necessary rights to such content and authorises Forja3D to use it for promotional purposes relating to its products or services.

This authorisation may include use on:

The website.
Social media.
Newsletters.
Marketing communications.
Other Forja3D promotional channels.

The customer's personal data will not be disclosed together with such content where there is no lawful basis permitting such disclosure.

The user may request that Forja3D cease using their promotional content by contacting Forja3D. Removal will be carried out from channels directly controlled by Forja3D within a reasonable period.

10. Newsletter Welcome Promotion

10.1. Organiser

The promotion is organised by the owner of the Forja3D online store, whose details can be found in the Legal Notice at www.forja3d.es.

10.2. Rewards

Customers subscribing to the newsletter for the first time may choose one of the following welcome rewards:

€5 discount on an order with a product value of at least €60.
Free pack of 4 rotary counters, valued at €5.95, on an order with a product value of at least €80.

Each subscriber may receive only one of the two rewards.

10.3. Requirements

To qualify, the participant must:

Be at least 18 years old.
Provide a valid email address.
Expressly consent to receiving the Forja3D newsletter and marketing communications.
Where applicable, complete the email address confirmation process.
Not have previously received a welcome reward for subscribing.

The promotion is limited to one reward per person, email address, customer account, postal address and household.

10.4. Delivery and Expiry

Once the subscription has been successfully confirmed, the participant will receive the promotional code or corresponding instructions by email.

The reward will remain valid for 30 calendar days from the date on which the code or instructions are sent.

The code must be applied before the order is finally confirmed.

Codes cannot be applied retrospectively to orders that have already been completed.

10.5. €5 Discount

The discount may be used on orders with a product value of at least €60.

The following shall not be included when calculating the minimum order value:

Shipping costs.
Surcharges or additional services.
Products expressly excluded from promotions.
Amounts covered by other discounts where the conditions of those discounts so provide.

The discount:

Cannot be exchanged for cash.
Does not generate account credit.
Must be used in a single order.
Cannot be used to purchase gift cards.
Cannot be combined with other promotional codes unless expressly stated otherwise.

10.6. Counter Pack

The free pack of four counters may be obtained with an order whose product value is at least €80.

The pack:

Cannot be requested or shipped separately.
Must be included with the qualifying order.
Cannot be exchanged for cash or store credit.
Is subject to availability.
May feature minor variations in colour, design or finish compared with promotional images.

If the pack is unavailable, Forja3D may offer:

An equivalent product.
A €5 discount.
The option to wait until it is back in stock.

10.7. Cancellations and Returns

If the entire order is cancelled, the reward will be considered used and the code will not be automatically reactivated.

Forja3D may issue a new code where the cancellation occurs for reasons not attributable to the customer.

If a return causes the order to fall below the minimum value required for the promotion:

In the case of the €5 discount, the refund will take into account the amount actually paid for the products.

In the case of the counter pack, the complete pack must also be returned. If the customer chooses to keep it, €5.95 may be deducted from the refund provided that the customer was informed of this condition in advance.

Nothing in this section shall limit the customer's statutory rights in the event of a defective product, an error in the order or a lack of conformity.

10.8. Unsubscribing from the Newsletter

The user may unsubscribe at any time using the unsubscribe link included in communications or any other mechanism provided by Forja3D.

Unsubscribing will not affect orders already placed and will not require the return of a reward that has been correctly used.

A subsequent new subscription will not entitle the user to another welcome reward.

10.9. Misuse

Forja3D may cancel codes or rewards obtained through:

False email addresses or email addresses used fraudulently.
Creation of multiple accounts.
Use of another person's details without authorisation.
Manipulation of the promotional system.
Exploitation of technical errors.
Any action intended to circumvent these Terms and Conditions.

Where appropriate, the value of a reward obtained or used improperly may be taken into account when calculating any refund relating to an order associated with such fraudulent use, within the limits permitted by law.

10.10. Duration and Modification

The promotion will remain in force while it is advertised as active on the Forja3D website.

Forja3D may modify, suspend or terminate the promotion for commercial, technical, legal, availability or fraud-prevention reasons.

Changes will not affect rewards validly obtained before the change and which remain within their validity period, unless legal, technical or fraudulent circumstances justify otherwise.

10.11. Data Protection

Data provided during subscription will be processed for the purpose of managing the promotion and, where the relevant consent has been granted, sending the Forja3D newsletter and other marketing communications.

The user may withdraw their consent and exercise their applicable data protection rights using the procedures set out in the Forja3D Privacy Policy.

11. Changes to These Terms and Conditions

Forja3D may update these Terms and Conditions to reflect legislative changes, changes in the operation of the store, new services or commercial requirements.

Changes shall apply to orders placed after the new version enters into force and shall not retroactively alter the conditions applicable to orders already concluded, unless otherwise required by law.

12. Applicable Law and Consumer Rights

These Terms and Conditions shall be interpreted in accordance with Spanish law and any other applicable legislation.

Nothing in these Terms and Conditions is intended to exclude, restrict or prejudice any mandatory rights granted by law to consumers and users.

If any clause is declared null, invalid or unenforceable, this shall not necessarily affect the validity of the remaining Terms and Conditions.

13. Acceptance of the Terms and Conditions

By placing an order through Forja3D, the customer acknowledges that they have had the opportunity to review these Terms and Conditions before completing the purchase.

In the event of a conflict between a general condition and a specific condition clearly stated on a product page, promotion or service option, the relevant specific condition shall apply, provided that it complies with applicable law.

Statutory rights granted to consumers and users shall in all cases prevail over any incompatible contractual provision.
